License Withdrawal and Lawsuits: Will Binance Go Down?

0

Recently, the cryptocurrency exchange has had problems in Australia.

The Binance cryptocurrency exchange has become by far the largest cryptocurrency trading venue in almost 6 years. However, during its rapid rise, the company has often traded integrity for rapid growth. License withdrawals, lawsuits, and other critical attacks on the company are now piling up, suggesting a Binance crash soon.

In an article published about two weeks ago, details about the crypto exchange are revealed. Among other things, these were payments from the terrorist organization Hamas, the then CCO Samuel Lim is said to have supported or at least allowed these processes to take place.

These reports were just the culmination of a history of dubious business practices that have come to light on the crypto exchange. A major factor in Binance’s skepticism is the fact that the company appears to have no official physical headquarters in any country in the world.

What are the Latest Crypto Exchange Concerns?

Recently, the cryptocurrency exchange has been having trouble in Australia. The Australian regulator ASIC requested the suspension of the derivatives license for Binance Down Under. The platform must stop trading derivatives before April 21. However, it is still possible to trade cash.

Information revealed by Bloomberg adds to Binance’s problems. As reported on April 5, the Virtual Assets Regulatory Authority (VARA), the entity that oversees cryptocurrency activities in Dubai, has asked Binance to provide more information on its trading requirements, in its efforts to tighten regulatory controls in the emirate.

Additionally, the US Commodity Futures Trading Commission (CFTC) recently filed a lawsuit against CEO Chanpeng Zhao (CZ). Especially in Western countries, which are still the most important places for the international financial market, Binance is increasingly getting into trouble.

The recent bankruptcies of Silvergate and Signature Bank left Binance.US without banking services, relying on intermediary banks to store funds on its behalf, according to the Wall Street Journal, citing “people familiar with the matter.”

Consequently, as informed by the WSJ, Binance.US clients have been affected by the lack of a direct bank. In a recent status update, the exchange said it was “transitioning to new banking and payment service providers over the next few weeks,” adding that some USD deposit services would be temporarily affected during the transition.

Will Binance Fall in the Next Months?

Based on the abovementioned, the impacts for Binance are getting closer, and the bears or harsh critics of the platform expect that the exchange could suffer a fate similar to that of FTX in the coming months.

It is worth mentioning, though, that Binance is by far the largest exchange on the market, and probably has significantly larger financial reserves than FTX. It could well be that Binance continues to struggle with license withdrawals and has to survive various lawsuits. Despite this, it could still work without a hitch.

The advice to investors is to avoid, by all means, leaving large sums of cryptocurrency or FIAT money on Binance. It is always best to use one’s own wallet (“Not your keys, not your coins!”). Whether to continue using Binance to buy and trade is up to each investor.

Mt. Gox Will Make Payments in October, with Possible Delays

0

This Friday, through a statement, the closure of the payment registration process that Mt. Gox will carry out for the month of October was announced.

October looks like the tentative date when Mt. Gox will make pending payments to defrauded creditors from nearly a decade ago. However, a new delay is expected, as is usual in this situation that affects dozens of pioneer investors in the crypto market.

The statement considers that all forms of reimbursement (base, intermediate, and early lump-sum repayments) will be made until the last day of October 2023. They add that, with the permission of the Tokyo District Court, the date could be extended. The latter could mean a new episode of uncertainty for people waiting for the return of their funds.

Mt. Gox to Make Pending Payments to Its Users Fourteen Years Later

Now that Mt. Gox will make pending payments to its defrauded customers in 2014, the memories of that event are very vivid. At the end of 2022, the world’s second-largest centralized trading platform, FTX, went bankrupt. Previously, dozens of small and medium-sized exchanges had shut down in the middle of the crypto winter.

Such a scenario affects other large platforms equally, due to the mistrust of regulators. The US SEC and similar agencies in other countries are increasing pressure on heavyweight platforms such as Coinbase and Binance, which could lead to the bankruptcy of the companies behind those exchanges.

Nearly a decade ago, the exchange that is now set to return funds to its users suffered a massive hack. Between 650,000 and 850,000 bitcoins were stolen by hackers, which remains the biggest theft ever in that industry. Part of these funds were recovered by the authorities, and they will be directed toward the payment to users.

As a result, after years of controversy, delays, and pressure, Mt. Gox will make any remaining payments to registered users. The latter includes the clarification of benefits and type of payment.

Follow-up Steps

The return process will be carried out by the Rehabilitation Trustee. who will carry out the “necessary preparations” so that the Mt. Gox payments are operated satisfactorily. Such preparations include confirmation of selections for payment, as well as the exchange of information with banks. The latter includes contact with fund transfer providers, exchanges, and other payment-related platforms.

It should not be forgotten that the funds recovered from this breach remained in limbo for years. It was not until 2018 that a court in Japan approved the compensation plan.

Since then, delays and deadlocks have been the common denominator of this process. Judging by the recent statement, everything indicates that the slowness and obstacles will continue after the date set to close the refunds.

Either way, the payments to be made by Mt. Gox are closer than ever. It should be noted that the price of BTC at the time of the looting of the exchange was $700 per coin. Currently, the value of the coin increased by approximately 4,000%.

US Congressman Tom Emmer Criticizes SEC Chairman Over Crypto Regulation

Emmer, who serves as the US representative for Minnesota’s 6th District, is well known for his crypto-friendly stance.

US Congressman Tom Emmer, as a podcast guest, referred to the Chairman of the Securities and Exchange Commission (SEC) Gary Gensler, in regard to the agency’s regulatory acts in the cryptocurrency sector.

On April 7, through Unchained, the popular cryptocurrency podcast, Emmer accused Gensler of regulating the cryptocurrency sector in bad faith. Tom Emmer believes that the head of the SEC holds the same anti-crypto belief as billionaire Warren Buffet, and has been blindly cracking down on the cryptocurrency industry while neglecting the really bad players in the industry.

Emmer stated that Gensler, in his opinion, “is a bad-faith regulator. He has been blindly spraying the crypto community with enforcement actions while completely missing the truly bad actors.”

Congressman Tom Emmer, who serves as the US Representative for Minnesota’s 6th District, is well known for his crypto-friendly stance and has sponsored many bills aimed at growing the space, including the Values Clarity and, recently, Blockchain Regulatory Clarity.

Emmer: “Enter Gensler’s Open Door Stance at Your Own Risk”

Gensler is known for calling for an open-door policy when it comes to cryptocurrency businesses and operators. However, Emmer believes that this policy is nothing more than mere words. “Gary Gensler might have an open door, but it’s an entry door at your own risk,” he said on the podcast, while exemplifying the recent debacle between the SEC and Coinbase, a cryptocurrency exchange that Emmer describes as one of the most regulation-compliant crypto companies.

Tom Emmer noted that Coinbase had tried to tap into the “Gensler open door” by engaging with the SEC regarding the Earn Product, which the exchange intended to list for its clients.

However, after several meetings that took place over several months, the agency did not provide comment on this inquiry, opting instead to criticize the crypto exchange with a Wells Notice.

Overall, the US Majority Whip believes that Gensler’s approach to the crypto space does not bode well for the US crypto market, and it should not be associated with the US government. The Congressman asserted that “Clearly, this is not the way the government should serve the American people, and I think it sends a clear message to the broader crypto community, and that is square: Gary Gensler is not regulating in good faith.”

Congress to Intensify Crypto Legislation Efforts in Coming Weeks

Blockchain Association’s Director of Government Relations Ron Hammond has stated that the general public should expect significant progress on cryptocurrency legislation in the coming weeks. Hammond, upon commenting on Tom Emmer’s podcast appearance, stated that members of the US Congress were currently working in their respective districts this week and the following.

Nevertheless, the last two weeks of April should be busy as “regulatory oversight and legislation intensifies.” That being said, the crypto market remains strong, with a total market capitalization valued at over $1 trillion.

Bitcoin Leads Crypto Market Recovery as Regulators Rise Temperatures

Mining stocks are soaring, but private equity firms remain cautious as some expect the crypto market to recover.

March has been a busy month for the crypto industry. Bitcoin has had its highest weekly close in 10 months and has led many to hope that the bear market is over.

One of the main drivers of this prediction was a series of banking crises in the United States as this has led investors to assume a rate cut later this year, despite Fed Chair Jerome Powell’s insistence that lower rates are not part of the baseline scenario for 2023.

However, optimism about the macroeconomic environment has the risk of being offset by a regulatory crackdown on the sector in the United States. This mixed environment is markedly different from the typical bull and bears markets to which the crypto industry is accustomed and affects its various regions in different ways.

Stagflation Discourages Venture Capital Funds

According to the latest information from the Cointelegraph database, investment activity in the blockchain sector dropped significantly in March, as there were only 59 individual transactions, down from 96 in February. This represents a 38.5% decline in investment activity. Total inflows in March were $504 million an important reduction of more than 42.7% from February’s $880 million.

Private equity funds require stable and favorable macroeconomic conditions that can support the growth of high-risk companies. The risk of a stagnant inflationary environment in the long term makes difficult this target achievement that is why sentiment among private equity investors has been on a downward trend in the near term. Until there is a change in macroeconomic indicators that moves investors from risk-off to risk-on, it is possible that investors’ sentiment in the blockchain sector will continue to stagnate or decline.

In the view of some experts, investor sentiment has ranked the blockchain sector 3 out of 5, indicating that venture capital investment continues to be hampered by macroeconomic factors. However, venture capital activity could be a lagging indicator of any future recovery.

Mining Stocks Take the Lead

Crypto stocks had a mixed performance in March. While mining operations have boosted stock prices due to higher revenues, other types of crypto companies have struggled, for example, Coinbase, Canaan, and Block.

The price of the latter continues to be affected by Hindenburg Research’s short-selling attack. In terms of mining, the biggest profits went to Riot Platforms, up 60%, Cipher Mining, up 53%, and Terwulf, which now operates a nuclear-powered mining facility that provides cheap electricity for mining, up 47%. This outperformance compares favorably with BTC’s 23.0% month-over-month return and 20.4% increase in mining revenue meaning that crypto stocks continue to underperform significantly against Bitcoin.

The crypto industry is expected to operate in a more favorable environment, with a more relaxed interest rate situation and reduced debt for miners in the coming months.

However, the macroeconomic perspective remains volatile and the market should continue to adopt a risk-averse approach. With the new information on the first quarter of 2023 results, investors will be paying close attention to the financial statements to look for any signs of strength or weakness in the crypto sector.

Binance Loses License in Australia

At the request of the exchange itself, the ASIC cancels Binance’s derivatives division in Australia.

Regulatory concerns surrounding Binance’s operations appear to be increasing. In this regard, the main Australian securities regulator announced the cancellation of the derivatives license of the Australian arm of Binance.

As reported via the Key Alerts Telegram group, starting April 14, Binance derivatives clients in Australia “will not be able to open or increase their existing trading positions.” By April 21, Binance will be required “to close the remaining trading positions,” the regulator stated.

Interestingly, the exchange had been under review by the Australian Securities and Investments Commission since February. This happened after Binance acknowledged that a “small number” of clients were trading at a higher level than allowed.

Following the official statement, the license allowed it to create and issue a derivatives market. as well as trading financial products on behalf of another person, and providing financial advice to retail and wholesale users in Australia.

“It is critically important that AFS licensees classify retail and wholesale clients in accordance with the law,” said ASIC Chair Joe Longo.

The Australian Securities and Investments Commission (ASIC) Terminates Binance’s Operating License

The move follows a request from Binance on April 5. The following is highlighted in said request:

“ASIC has today (April 6) canceled the Australian financial services license held by Oztures Trading Pty Ltd trading as Binance Australia Derivatives (Binance). The license cancellation was effected today in response to a request to cancel received from Binance yesterday (April 5).”

Dates to Consider

According to the cancellation terms that have been published, these dates must be taken into account:

  • As of April 14, 2023, clients will not be able to increase derivatives positions or open new positions with Binance.
  • Binance will require clients to close any existing derivatives positions by April 21, 2023.
  • On April 21, 2023, Binance will close the remaining open positions.

The terms of the cancellation include a provision that allows Binance to continue being a member of the Australian Financial Complaints Authority until the end of April 8, 2024.

Warning from the Australian Securities and Investments Commission

In any case, ASIC has repeatedly warned potential crypto users that cryptocurrencies are risky and complex, as they pose additional risks to consumers through leveraged trading.

Many products and crypto services are not regulated by ASIC. Therefore, more than with other types of investments, users of cryptocurrencies must be prepared to lose the funds they invest. Longo explained that “ASIC supports a regulatory framework for crypto with a focus on consumer protection and market integrity. The final decision as to the regulatory settings is one for Government.”

Binance’s Ongoing Commitment

Finally, Binance blogged more details of the process, apologizing for “any inconvenience this may cause and we will be closely monitoring the process to ensure it is as seamless as possible,” reassuring that users will continue “to access and enjoy Binance Australia’s spot trading platform.”

Fantom Hits a New Milestone – Will It Help FTM Get Through Q2?

0

Daily active users and FTM transactions decreased. On-chain performance wasn’t up to par; however, market indicators were slightly bullish.

Fantom is a platform created with the aim of providing a fast and cheap infrastructure to developers of decentralized applications. To do this, it uses a technology called DAG that is more efficient than the Blockchain. Its native token is FTM, and it can be purchased on the main platforms such as Binance or KuCoin, among others.

Fantom [FTM] recently reached a new milestone, having more than 50 million unique addresses on the network. This is a commendable achievement, as year-over-year growth exceeded 1,700%.

Fantom tweeted that “The number of active addresses on @FantomFDN has reached over 50M in total, 1758.28% in YoY. More and more big things are coming. 100M is coming soon.”

But… There Is a Catch

While the growth in unique addresses seemed very promising for the Blockchain, the same was not true for the number of daily active users. Token Terminal’s data revealed that FTM’s daily active users registered a decrease in the last 30 days.

A similar trend was also seen with the network’s successful transactions, which also fell. Considering the current situation, it is worth asking if a higher number of unique addresses will be enough for Fantom to maintain its health in the second quarter of 2023.

Assessing Fantom’s Performance

Evaluating Fantom’s on-chain performance, some factors were found that were not in favor of the Blockchain. For example, FTM development has plummeted in the last 30 days, which is a red signal for a Blockchain. To make matters worse, negative sentiments around FTM have peaked, suggesting lower investor confidence in the network.

Will the Q1 Winner Perform in Q2?

Fantom Insider noted in a tweet posted on April 6, 2023, that FTM ranked third on the list of cryptocurrencies by the percentage increase in price during the first quarter of 2023:

“Check out the Ranking Blockchain by Percentage Increase in Price in Q1 2023 … @FantomFDN is growing well with a growth rate of up to 110.62%. The market is pumping! What price do you expect Fantom to hit next quarter?”

Growth appears to have stopped. The declining momentum can be attributed to the current market conditions, in which most cryptocurrencies are struggling to push their prices higher.

As noted by CoinMarketCap, the FTM price has risen just over 1% over the past seven days. Most recently, it was trading at $0.459 with a market capitalization of more than $1.2 billion.

The Santiment data revealed that some of the metrics suggested the possibility of a downtrend in the coming days. However, Fantom’s daily chart showed signs of recovery. The Chaikin Money Flow (CMF) posted a rally, which was a development in favor of buyers.

Finally, the exponential moving average ribbon showed a bullish crossover, as the 20-day EMA inverted the 55-day EMA. FTM’s Money Flow Index (MFI) was also unsettled above the neutral mark, giving hope for a price hike in the coming days.
