SEC is Searching Data on Ripple and XRP in 20 Entities outside the United States of America

Research on Ripple outside the US includes cryptocurrency trading platforms. Ripple demanded the SEC to stop requesting information about the firm internationally.

Ripple Labs Inc., the company that owns the cryptocurrency XRP is under the magnifying glass of The United States Securities and Exchange Commission. This time, the government entity is searching to gather data about the firm’s movements internationally.

The SEC revealed its intention in a letter consigned on Friday, April 23, to Sarah Netburn, a judge for the District of New York. The letter alleges that it requires knowing if the cryptocurrency company committed irregularities for the alleged collection of at least USD 1.3 billion since 2013 by selling XRP.

The SEC Seeks Ripple and XRP Information, and it Includes Trading Platforms

The SEC seeks Ripple and XRP information on 20 entities outside the United States of America, including trading platforms. The Commission highlights that information on overseas Ripple and XRP transactions are essential to the lawsuit. But of the nine foreign regulators the SEC has already asked for information, two have refused to cooperate.

In April 2021, Ripple demanded that the SEC stop requesting information about the firm and XRP abroad. However, SEC attorney Jorge Tenreiro noted that Ripple’s request is devoid of legal authority and considers its request to foreign regulators to be appropriate.

The SEC maintains a legal precedent for using requests for support during civil litigation because they are requests, not enforceable commands by federal courts. Therefore the Federal Rules of civil procedure can’t forbid those commands.

Sharing Information with the Opposing Party

The SEC has investigated the cryptocurrency addresses associated with both Ripple CEO Brad Garlinghouse and co-founder Chris Larsen. The entity argues that this investigation has revealed that millions of XRP have allegedly been transferred (directly or indirectly) to a dozen non-US cryptocurrency exchanges.

The SEC insists in the letter delivered to Judge Sarah Netburn that Ripple did not provide a single document relating to its digital asset accounts in the United States of America, nor has it explained in any other way the importance of these XRP transfers.

The Legal Battle between the SEC and Ripple Labs is reaching new levels

The lawsuit between the SEC and Ripple Labs INC has been going on since December 22, 2020. The legal action filed by the SEC even reached its co-founders, Christian Larsen and Bradley Garlinghouse.

They are accused of the alleged sale of XRP to support financial activities in the company. The SEC sees that asset to be an unregistered security. Ripple, for its part, argues that it is, in fact, a “virtual currency.”

Since then, a lot of conflict between the parts has happened. Among the most notable events that occurred is that the Binance and eToro platforms suspended XRP trading in the United States of America. This legal battle between the SEC and Ripple Labs, in recent weeks, has turned in favor of its cryptocurrency XRP because its price increased 14.23%.

The BCRA Requests Argentine Banks for Information on Customers Who Make Transactions with Bitcoin

By April 30th at the latest, banks and Fintech companies must send the information to the Central Bank. The banking authority of the South American country could establish new regulations on the use of cryptocurrencies.

The Central Bank of the Argentine Republic (BCRA) set April 30th as a deadline for banks and FinTech companies. The latter must inform the banking authority about the transactions with cryptocurrencies that their customers have made during the last year.

According to the local newspaper Clarín, these companies must report data on their customers’ transactions with these types of assets. The BCRA wants to know about those who “administer, manage, control and process asset movements using crypto assets.”

The central bank may be seeking to collect information on companies that are customers of the banks rather than on private users.

At first, the deadline was April 7th, but a lawyer filed a writ of habeas data against the BCRA. The action was intended to stop the collection of data on users’ transactions with Bitcoin and other cryptocurrencies.

The aforementioned newspaper reported a source who considers that the event will only represent “greater bureaucracy.” However, that person said that it will not impede the development of the industry. He explained that all activities of Bitcoin exchanges and other cryptocurrency companies are banked. Likewise, he noted that they issue the corresponding invoices so that the transactions are transparent.

Other anonymous sources gave statements to the local press about the use of stablecoins. They said that these crypto-assets “allow many to satisfy their interest in dollarizing their savings without affecting [national] reserves.” Therefore, cryptocurrencies could become “a positive externality” for the BCRA.

There Will Be Tighter Regulations on Bitcoin Worldwide

The reason for measures such as the aforementioned seems to be to study whether it is necessary to incorporate a new regulation on crypto assets. “It is common to request banks for information on different topics of interest before moving forward with regulations,” said another insider.

Argentina already has regulations related to the cryptocurrency ecosystem and some people fear that excessive regulation will “drown” the industry.

As a member of the Financial Action Task Force (FATF), Argentina does not escape the recommendations of this organization. One of the latest reports from this entity suggests what it considers to be convenient for governments. They believe that it is best to prohibit the withdrawal of cryptocurrencies from exchanges and brokers to private self-custodial wallets.

Several players in the cryptocurrency industry strongly criticized this type of recommendation worldwide. Among them is Brian Armstrong, CEO of the Coinbase exchange, who believes that “regulating self-custodial wallets puts the innovation at risk.” In any case, many believe that stricter regulations on Bitcoin will be inevitable even though they are a cause of concern.

Argentine regulators are not the only ones who do not like cryptocurrencies that protect the privacy of their users. The governments of the United States and South Korea consider that these types of assets favor money laundering. For that reason, they are constantly working on new regulations to control/prohibit their use within their economic systems.

The Bitcoin Network Looks Healthier After the Cryptocurrency Exceeds USD 53 Thousand Again

The price of the pioneering cryptocurrency has recovered more than 12% since its last low point. Dogecoin and Monero are the only ones among the major cryptocurrencies on the market that are in the red.

This week started well for Bitcoin (BTC) as its price seems to be recovering, once again exceeding USD 53,000. Besides, the network looks healthy after the return of miners’ hash rate and the drop in transaction fees.

At the start of the week, the price of Bitcoin rose by more than 8% in 24 hours, according to data from CoinMarketCap. Thus, there has been a confirmation of the rapid rebound after the drop of more than 20% in recent days.

Taking into account its latest low point, the rise in the price of Bitcoin has been above 12%. The main cryptocurrency on the market went from USD 47,250 to USD 53,200 in a matter of hours. Although the price of Bitcoin rallied, it remains far from its all-time high above USD 64,000 per unit.

The major cryptocurrencies on the market have accompanied Bitcoin’s positive movement in recent days. Only Dogecoin and Monero have shown red numbers among the top 50 of the market. Meanwhile, Ripple (XRP), Ether (ETH), Cardano (ADA), Uniswap (UNI) and Polkadot (DOT) have gained between 9% and 12%.

The reason for the rise in the price of the pioneering cryptocurrency seems to be the recovery in the hash rate. The processing power of miners on the Bitcoin network fell by as much as 40% on April 15th. At that moment, it touched 110 EH/s of accumulated power on the network.

The Collapse of the Hash Rate and High Fees on Bitcoin

According to data from statoshi.info, the network already accumulates more than 160 EH/s of hash rate. Since fees returned to regular levels, around 40 satoshis per vbyte is enough for a transaction to go into the next block, according to mempool.space.

With this behavior, the correlation between the power that miners bring to the network and the price of the cryptocurrency is confirmed. Although they fell one after the other, they have been able to recover.

In mid-April, there was a power outage in China’s Xianjing province. This situation caused the collapse in the hash rate given the great concentration of mining power in the Asian country.

The drastic loss of mining power led the Bitcoin network to enter into heavy transaction processing congestion. Additionally, fee costs rose to higher levels than usual, above 200 satoshis per vbyte.

There was a drop in the value of BTC in the market due to an apparent crisis of trust in the health of the network. That drop happened quickly after Bitcoin had reached the new all-time high just the day before.

The same as on previous occasions, the health of the Bitcoin network has resumed its course. The cryptocurrency has shown that it is capable of hitting new all-time highs after suffering big drops. It is only a matter of time before the price of the main cryptocurrency on the market achieves new record levels.

Grayscale Bitcoin fund loses $ 1 Billion and is Trading at a Significant Discount

The world’s largest bitcoin fund has been trading at a negative premium for two months. GBTC is now less attractive as other financial instruments appear on the market.

Grayscale lost more than $ 1 billion to its leading item, the Grayscale Bitcoin Investment Trust (GBTC). It keeps its trading behavior at a significant discount compared to the volume of assets managed by the institutional investment fund.

According to data updated by Grayscale, on April 21, the assets managed by the fund were $ 36.46 billion. However, in the update on the 22nd, it reflected $ 35.285 million, a loss of $ 1.175 million, as bitcoin continues to face downward pressure, with the asset falling 19% this week, according to data from CoinMarketCap.

The particular situation with GBTC and its trading rate at a 19% discount is its lowest point in history, according to YCharts. This low point means that each GBTC share’s buy/sale is at a price 19% below its issue cost.

Grayscale Bitcoin Trust Crumbles down to Unexpected Levels

Until recently, GBTC was one of the few options for institutional investors to expose themselves to bitcoin. GBTC was catching a lot of interest as their share premium peaked at nearly 41% last year.

However, it became less attractive as more institutional investment items appeared on the market, such as the Bitcoin exchange-traded funds (ETFs) that have hit the market, three of them recently launched in Canada.

In March, Grayscale froze every intention to invest in GBTC. It did so a few days after the Bitcoin Trust traded at a discount that reached 15%, a figure below the value of BTC that each share represents. The drop has not received enough divulgation from the company since then.

The premium needed a push into positive territory, so Digital Currency Group, Grayscale’s parent company, announced that it would purchase up to $ 250 million worth of GBTC stock on March 10. But this purchase never came to fruition.

Recently, the firm announced that it wants to transform GBTC into a listed fund ETF. However, the company founded in 2013 did not explain detailed procedures with the United States Securities and Exchange Commission to crystallize this initiative.

Discount the Shares of GBTC in the Past

GBTC holders suffered a substantial burden due to the unexpected discount the shares of GBTC have traded in the past. Due to the insufficiency of an investment tool that could unlock retirement funds, GBTC was the only available option. Also, GBTC was able to command a vital premium to the net asset value.

Grayscale capitalized on this demand by bringing qualified investors the chance to invest in the trust at NAV, while the after-market designated a premium to NAV. The trust needed an initial investment of $ 50k with a lock-up period of one year. Once the lock-up period meets its end, the shares can find a spot on the secondary market.

BitGo is About to Offer Custody to Seized Bitcoins

The exact duration of this agreement between both parties remains unknown. The entity was looking for a company that could lead the management of cryptocurrencies since 2019.

The United States Allocation Service recently published a contract indicating that the BitGo custodian company is up to administer the bitcoin schemed by the police force through confiscation proceedings.

The agreement for the cryptocurrency receipt goes around USD 4.5 million, according to the document that came to light on April 21, 2021. Right before the BitGo association with the applicable agency of the league, the USMS, the FBI, and The Justice Department are managing the bitcoin transactions and the submissions.

Although the exact duration of this agreement remains unknown, the USMS announced in 2019 that a company would be working to bring all the range of management and elimination of digital currencies.

Among the active services working through this agreement are accounting, completion of audits, creation, and management of charters, generation, retrieval of private keystrokes, and air handling of retained cryptocurrencies.

The USMS is a branch of the Department of Justice of the United States. In one of its first subbases, Tim Draper purchased a sum that surpasses $ 30,000 in BTC, which went through confiscation from the darknet market, Silk Road.

Recently, in November 2020, the Department of Justice revealed that it had collected more than USD 1,000 million in bitcoins from this market. The surrogate of a person known as “Individual X”, and allegations are suggesting this may have been one of the individuals involved in the robbery of bitcoins during the investigation.

Bitcoin Volume Receives Full Support from the Authorities

The US Marshal Bitcoin Auction website, created by Casa CEO Jameson Lopp, states that bitcoin protection is seeing an increase to show the volume of BTC underpinned by authorities. This website reveals that the volume is currently facing an update in 185,230 BTC, which equates to USD 9,400 million on the current exchange.

BitGo is a digital asset custodian company founded in 2013 by Mike Belshe and Ben Davenport. The firm acquired the most recent license from the New York City Department of Financial Services (NYDFS, in English) to consolidate a cryptocurrency commission that can be useful to Wall Street institutional investors.

This license allows BitGo to make its independent and custodial service work at the New York City Bank Ley Bancaria. Other companies that have similar charges include Paxos, Gemini, Coinbase, NYDIG, and Bakk.

Users having this license might bring significant benefits to BitGo; it also means constant regulatory scrutiny. The institution paid USD 100,000 to the Department of Treasury of the United States before due to violations of rules administered by the Office of Control of Foreign Activists.

As of 2018, BitGo acquired a license from the NYDFS bank. While operating from the Dakota Bank of the South, now in New York, it tends to compete with other custodian service institutions that hold a license, like Coinbase, Gemini, and Paxos.
