Garland Recommends Biden to Work on International Cooperation to Regulate Bitcoin

According to the US Department of Justice, it is more difficult to prosecute crimes committed with cryptocurrencies than with fiat money. The government highlights that blockchain platforms keep permanent records of transactions on distributed ledger technology publicly available on the Internet.

Merrick Garland, the US attorney general, recommended that President Joe Biden works on strong international cooperation to regulate Bitcoin (BTC) and other cryptocurrencies.

The message from Garland is part of a recent report by the US Department of Justice in response to the Executive Order issued by Biden.

The government agency raised that internal US organizations and foreign entities responsible for preventing crimes must work in a coordinated manner to regulate the ecosystem.

They also mentioned the issue of crimes committed with cryptocurrencies based on their higher adoption.

The Attorney General believes it is crucial to share more information with foreign law enforcement agencies. He told President Biden that better collaboration would help avoid duplicating efforts, which wastes investigative resources.

According to Garland, the Executive Order issued by Biden states that the growing use of crypto assets affects investors, consumers, and businesses. It also claims that it increases the risk of money laundering, ransomware, terrorism financing, fraud, theft, and sanction evasion.

The Department of Justice added that it has begun to work cooperatively with the State Department and the Treasury Department. Other agencies include the Department of Homeland Security, the Securities and Exchange Commission (SEC), and the Commodity Futures Trading Commission (CFTC).

They say they will direct their efforts at determining how to strengthen international law enforcement cooperation best. They seek to expand operational capacity and close regulatory gaps between jurisdictions.

International Cooperation to Help Fight Crimes Involving Cryptocurrencies

The report indicates that international cooperation would help overcome the obstacles posed by the characteristics of Bitcoin and other cryptocurrencies. That way, it would be possible to intensify law enforcement efforts and combat their misuse.

The Attorney General and the Department of Justice consider that an international strategy is crucial for detecting, investigating, prosecuting, and disrupting cryptocurrency-related criminal activities.

They explained that crimes committed with cryptocurrencies are much more difficult to prosecute than those involving fiat money.

They pointed out that criminal actors exploit innovation, decentralization claims, and anonymity features of cryptocurrencies. The report states that they commit crimes with crypto assets much faster as they avoid traditional financial intermediaries.

However, they highlight the advantages of blockchain platforms, as they keep permanent records of transactions on distributed ledger technology publicly available on the Internet.

That provides further opportunities for law enforcement officers to track money, which is impossible with traditional financial systems.

The response from the Department of Justice is among the first from US agencies to the presidential request.

In March, Biden required federal agencies to examine the risks and opportunities that cryptocurrencies represent to the country. He sought to determine how they affect the national security of the United States and its economy.

Some People Think that Stablecoins Are a Necessary Evil to Get to Bitcoin

Those unwilling to take the leap and get to Bitcoin in one jump may use stablecoins as a bridge. People looking for something familiar will see those coins as the transition between fiat money and the pioneering cryptocurrency.

Many agree that Bitcoin (BTC) is the current decentralized and innovative digital money. Most of the cryptocurrencies created later, including stablecoins, cannot solve the known problems of money.

The creation of stablecoins is questionable, as Bitcoin also emerged to counteract the issuance policies making the US dollar less stable. However, they may serve as a bridge for more people to understand BTC and incorporate it into their daily lives.

Concerning exchanges, new users can see them as banks and thus find it comfortable to use them to familiarize themselves with the cryptocurrency ecosystem.

Not everyone is willing to switch from the world of fiat to Bitcoin in one jump. For that reason, some tools can bring people closer to the pioneering cryptocurrency despite not corresponding to its value proposition.

New users see all cryptocurrencies as part of the same, a view with which many may agree or not. Since most Venezuelans think Petro is like Bitcoin, many receive stablecoins like Tether (USDT), not thinking about decentralization or issuance limits.

Stablecoins Offer the Illusion of Stability in the Short Term

Given that most people want stability, they are afraid to include Bitcoin in their everyday life. Due to market volatility, purchasing power becomes uncertain from one day to the next or even from morning to afternoon.

Stablecoins keep the value stable in the short term, but the US dollar has lost much strength, and inflation is worsening the situation. However, those living with cash do not find a drop of over 20% in a month attractive.

People have moved almost USD 70 billion worth of Tether over the last 24 hours alone. Regarding BTC, they have moved just over half, demonstrating the dominance of USDT, the main stablecoin in the market.

USDT, USDC, BUSD, and DAI are similar to national/fiat currencies, which people already know. Given that the world still runs on fiat money, people tend to demand more of those assets than the latest cryptocurrencies.

A World Dominated by Bitcoin Will Still Have Stablecoins

Not everyone using Bitcoin will become a true believer in it, as most use it as an investment vehicle. Meanwhile, a few others still believe it is a way to make quick and easy money.

Bitcoin may eventually become the protagonist, and the world will understand how it changes everything. However, that may never happen, and the US dollar or any other fiat currency may remain the unit of account.  In the latter case, using a stablecoin would be unavoidable and even a necessary evil.

Merchants find it inconvenient to price their products in BTC, avoiding fiat money or even stablecoins as a unit of account at all costs. The volatility in the market would enslave them to exchanges to change their prices. Even with an automated system, trading would be problematic for their customers due to the constant change in market value.

Bitcoin may become the preferred medium of exchange or store of value, but people will still need something better adapted to their everyday life. The answer is in stablecoins, which are halfway between what people know (fiat money) and Bitcoin.

Tether; an “Instrument of Freedom” and a “Pathway to Bitcoin,” Says Bitfinex CTO

Paolo Ardoino, CTO of Bitfinex and Tether, defended that Tether is a tool for human rights in Davos, Switzerland, during the World Economic Forum.

On a sunny day in the Swiss Alps, Bitfinex and Tether CTO Paolo Ardoino discussed Lugano’s Plan B strategy, Tether as a gateway to Bitcoin (BTC), and, above all, its favorite pizza ingredients.

Fresh from the plan in Norway, where Ardoino attended an increasingly Bitcoiner-friendly event, the Oslo Freedom Forum, the Italian explained that, in contrast to the WEF, there was no “shilling” in Norway.

About Tether’s Participation in Oslo

Tether was invited to speak at the Oslo Freedom Forum as the stablecoin is increasingly seen as an “instrument of freedom”. Tether has been adopted by the Myanmar government, while the Ukrainian government has accepted donations of cryptocurrencies, including Tether, since the start of the Russian-Ukrainian war.

Ardoino indicated that it is exciting to see how since 2014, the year that Tether (USDT) was invented, stablecoins have reached the highest echelon of legislators and regulators.

Every day, Ardoino says, more people use Tether to save, pay for college, travel, buy and sell homes, or make donations.

“Tether is one of the tools to be used by struggling countries where the national currency is devaluing, where people want an edge against insane inflation,” said Ardoino.

Ardoino cites Turkey and Argentina as examples. The Turkish lira has lost 50% of its purchasing power and cryptocurrencies, often seen as a hedge against uncertain currencies, are seeing a second wave of interest. Ardoino also admitted that:

“Bitcoin is great but they want price stability, long-term price stability. […] “Bitcoin is great for a lot of things but it’s still not understood by many.”

Regarding the Plan B strategy in Lugano, where Bitcoin and Tether are de facto legal tender in the Swiss city, Ardoino shared that educational models in Switzerland are being shared with El Salvador.

“Bitcoin is for everyone. You have people in a poor country who need Bitcoin as a basic financial infrastructure. On the other hand, you have a country with the largest number of banks in the world, and they still need Bitcoin.”

Last April, Ardoino spoke of the advantages and benefits of Tether, as compared to other stablecoins. According to him, Tether volumes compared to other stablecoins are incredibly higher, as much as ten times higher on a bad day. The main competitive advantage of Tether is that it is focused on people who have difficulties accessing financial services. Actually, it is perceived as an instrument of freedom. A solution, a tool that helps everyone. It is not a tool built for banks, nor for Wall Street.

USDT also differentiates itself from the competition by having a strong, conservative and liquid portfolio that strives to safeguard its reserves. USDT continues to lead the industry in terms of quarterly assurance certifications by independent accountants, demonstrating that all ties are fully supported and reserved.

Ardoino also criticized Satoshi Nakamoto’s choice of pizza toppings. Bitcoin Pizza Day occurred the day before WEF, a day when Bitcoiners around the world eat and try to pay for pizza with Bitcoin. Bitcoin creator Satoshi Nakamoto enjoyed pineapple and jalapenos on pizza, to which Ardoino commented, “no one is perfect.”

The Fed Compares the Fluctuation in the Price of Bitcoin and the US Dollar

A chart shows that Bitcoin has fluctuated much more than the price of the US dollar since January 2021. Long-term Bitcoin holders are suffering their heaviest losses since 2018 but may have to wait until finding some relief.

The US Federal Reserve (Fed) recently published a post titled Buying Eggs with Bitcoin: A Look at Currency-Related Price Volatility. They explained the fluctuation in the cost of eggs in Bitcoin (BTC) and US dollars over the last 14 months.

A chart in the report shows the monthly price of eggs in US dollars since January 2021. It indicates that prices fluctuated between USD 1.47 and USD 2.52 over the 14 months.

Another graph shows how Bitcoin performed over that period, noting that it fluctuated much more than the US dollar.

However, they do not specify whether the price of eggs rose or the US dollar devalued due to the trend.

A Cybersecurity Company Converts its Balance Sheet into BTC

Octagon Networks, a global cybersecurity networking company, recently announced that it had converted its liquid assets and entire balance sheet to Bitcoin (BTC). The group said they would also accept payments with the cryptocurrency for their services, giving their customers a 50% discount.

In that way, they become the first cybersecurity company to have its reserves in Bitcoin. They stated they would receive the crypto asset and offer a discount to encourage its use.

Binance is Under Investigation Due to ICO-Related Allegations

The US Securities and Exchange Commission (SEC) is investigating whether Binance has violated securities regulations, according to Bloomberg. Those allegations concern when the exchange launched the cryptocurrency BNB in an initial coin offering (ICO) in 2017.

The Binance ICO occurred across many platforms during the so-called ICO frenzy, two days before the Binance cryptocurrency exchange emerged. At least one US resident has claimed his participation in the ICO, which is crucial if the SEC decides to pursue legal action.

The exchange stated that it works closely with the authorities and will comply with all regulatory requirements.

Market-making companies controlled or partially owned by Changpeng Zhao are also under the scrutiny of the SEC. The government agency is particularly investigating those doing business with Binance.US, a US-based subsidiary of Binance.

Losses by Long-Term Bitcoin Holders Reach Lows After Two Years

Long-term Bitcoin holders suffer their heaviest losses since the March 2020 capitulation and the 2018-2019 bearish market. However, they may have to continue waiting until they find some relief from that situation.

The value of the coins deposited on exchanges allows determining the aggregate realized losses of Bitcoin (BTC) long-term holders. In late May, they exceeded 0.006% of market capitalization, according to a report from Glassnode.

However, there may be further losses if patterns from previous bearish markets reoccur.

The flows of BTC on exchanges have accounted for around USD 506 million in value, while ETH has experienced net outflows of USD 357 million. That suggests that the market sentiment toward ETH is much lower than that of BTC.

US Appeals Court Rules Do Kwon and Terraform Labs Must Heed SEC Subpoena Sent in September

Do Kwon, the founder of the collapsed ecosystem of Terra (LUNA), lost an appeal seeking to block the Securities Exchange Commission (SEC) from enforcing subpoenas over an ongoing investigation into the Mirror Protocol.

On June 8, a US court dismissed an appeal filed on behalf of Terraform Labs CEO Do Kwon, stating that he and his company are required to comply with Securities and Exchange Commission (SEC) investigations into Mirror Protocol, a platform company based in South Korea.

It is the latest development in legal tensions between the SEC and Kwon, upholding a February ruling requiring Terraform Labs and Kwon to turn over Mirror Protocol-related documents and testify before the SEC.

The Origins of Kwon’s Appeal

Mirror Protocol is a decentralized finance (DeFi) platform built on top of Terra that allows users to trade synthetic versions of stocks, such as Tesla and Apple.

Kwon’s appeal was filed on the basis that the SEC violated its rules when he was first served with a subpoena at the Messari Mainnet conference in October 2021.

The Terraform Labs CEO argued that his firm lacked sufficient presence within US markets. The appeal also argued that the summons should have been served on Kwon’s legal counsel, not him personally.

Terraform Labs Opposition to SEC Subpoenas

Kwon had opposed the SEC’s investigation, arguing that the agency does not have jurisdiction to regulate him or his company. According to the troubled CEO, he is a South Korean citizen residing in Singapore, where his Terraform Labs is incorporated.

However, in upholding the ruling, the appeals court asserted that the company has clients and investors in the US. Kwon also wanted the subpoena dismissed because the SEC did not go through his attorneys in notifying the court, noting that there was no official address to locate him.

US Appeals Court Ruling

The United States Appeals Court for the Second Circuit has ruled that the SEC was justified in subpoenaing Kwon and Terraform Labs on the basis of “the company’s marketing and promotion to United States consumers, retention of United States-based employees, contracts with United States-based entities, United States, and business travel to the United States, all of which related to Mirror Protocol and the digital assets at issue in the SEC investigation.”

The court also dismissed the argument that it was improper for him to be served documents in person due to noncompliance with electronically served SEC subpoenas.

The court stated that business deals with US companies to trade Mirror Protocol assets justified the SEC investigation, where “a $200,000 settlement with a US-based trading platform” was made. Additionally, Terraform Labs “indicated that 15% of Mirror Protocol users are in the United States” during negotiations.

Kwon’s Rising Legal Conflicts

Today’s ruling adds pressure to the scrutiny following the collapse of TerraUSD (UST) and Terra’s native currency, LUNA. The implosion prompted comments from regulators around the world about what happened as government officials highlighted stablecoins as potentially unstable and risky assets.

Following the collapse of Terra, Kwon also faces separate accusations of fraud in handling the Mirror Protocol. Adding to the Mirror Protocol controversy, Terraform Labs is accused of laundering $4.8 million through a South Korean shell company.

Indonesian-Licensed Crypto Asset Platform Pintu Raises $113M in a Series B

The latest funding infusion of $113 million will be redirected to scale the platform’s existing offerings, such as the introduction of new features and additional support for Blockchains.

Indonesian crypto asset platform Pintu has announced the closing of a $113 million Series B funding round involving four prominent investors: Pantera Capital, Intudo Ventures, Lightspeed, and Northstar Group.

Licensed by the Commodity Futures Trading Regulatory Agency (Bappebti) under the Ministry of Commerce, Pintu caters to Indonesian crypto investors trading popular cryptocurrencies such as Bitcoin (BTC) and Ethereum (ETH).

Other Views and Opinions

Bappepti previously highlighted the doubling of the number of Indonesian crypto investors in 2021-2022, to which Jeth Soetoyo, founder and CEO of Pintu, said that they believed “cryptocurrency adoption in Indonesia is only in its early stages, and educating users on the fundamentals is crucial to ensuring this growth continues in a healthy manner.”

The latest funding infusion of $113 million will be redirected to scaling the platform’s existing offerings, such as introducing new features and supporting Blockchain. The company is also planning to add more tokens and launch new products to further consolidate its position in Indonesia.

In just two years since its inception, Pintu launched numerous features on its mobile app that allow users to earn and stake their cryptocurrency holdings. Additionally, a portion of the Series B funding will be dedicated to Pintu Academy, an educational program for cryptocurrency traders that aims to spread the opportunities and risks of cryptocurrency investing.

Cryptocurrency in Indonesia: Sneak Peek

A recent analysis by Cointelegraph on April 3 noted that cryptocurrency investments in Indonesia saw considerable growth between 2020 and 2022, with 4% of the country’s population having invested in cryptocurrencies.

This growth has shaped a new mindset toward investing in cryptocurrencies, especially in the mainstream media. An example of the growing appeal of cryptocurrencies in the mainstream is the involvement of celebrities and influencers from Indonesia.

Celebrities and influencers in Indonesia seem to be much more involved in the Indonesian cryptocurrency investment industry since 2021.

Many have become brand ambassadors for crypto exchanges and projects to help promote them and increase trading volume substantially.

The involvement of the likes of Joe Taslim, an Indonesian actor gone global, and Indonesian models and actresses Jessica Iskandar and Shandy Aulia might not come as a surprise, considering the inevitable presence of celebrities in advertising and branding.

Some celebrities have even created their own cryptocurrency.

The celebrity listing trend has skyrocketed, especially after one of Indonesia’s top musicians, Anang Hermansyah, created his own listing.

Three tokens have gone viral in Indonesia as of February 2022: VCG (VCG), Asix (ASIX), and I-Coin (ICN).

The name of the celebrities who support them and their marketing team went viral on their token and caused a lot of fear of losing, or FOMO, from Indonesian investors for the first time.

But, long before these, the trend started with an influencer named Indra Kenz, who created her own token with her team called Botxcoin (BOTX).
