Alexander Vinnik, Founder of BTC-e, Seeks Prisoner Exchange with the US

His legal team wants Vinnik to be exchanged for Evan Gershkovich, a Wall Street Journal journalist currently jailed in Russia.

Alexander Vinnik, founder of a cryptocurrency exchange and accused of illegal activities, seeks to be part of a prisoner exchange between Russia and the US.

Vinnik, co-founder of BTC-e, is accused of aiding Russian cybercriminals. According to a WSJ report, his lawyers are seeking a protection order so that Vinnik can be considered in a prisoner exchange deal. Thus, he could be “exchanged” by the detained WSJ journalist Evan Gershkovich.

Alexander Vinnik and his Fight for Freedom

If the deal is successful, Vinnik would win his freedom in exchange for the release of Gershkovich, who was arrested in March on spying charges in Russia. Recently, his term of imprisonment was extended until August 30, 2023.

The case of possible prisoner exchange is striking for two essential aspects. One is that it is the first time since the Cold War that Moscow has jailed an American citizen on espionage charges. The second is the involvement of a cryptocurrency exchange founder in a geopolitical issue between two nuclear powers.

The Challenge of a Prisoner Exchange

David Rizk, Assistant Federal Defender for the Northern District of California, stated that Vinnik should be given the opportunity to respond to the allegations and publicly advocate for his inclusion in a prisoner exchange. However, he acknowledges that the agreement will not be easy to achieve and will require a lot of support.

Citing sources familiar with the prisoner exchange process, Rizk explained that such negotiations require a strong public campaign to “maximize the chances of such an exchange.” This is not Vinnik’s first attempt to be part of an exchange for citizens detained in Russia, but so far, his requests have gone unheeded.

The Context Behind the Prisoner Exchange

Prisoner exchanges are common in an environment of high geopolitical confrontation. The most recent trade occurred in December 2022, when the United States agreed to release arms dealer Viktor Bout in exchange for American basketball player Brittany Griner.

Vinnik was first arrested on money laundering charges in Greece in 2017 under a US arrest warrant and was later extradited to France in 2020. In France, Vinnik was acquitted on ransomware charges but convicted on money laundering charges. money and sentenced to five years in prison. After serving two years in a French prison, he was extradited to the United States on August 5, 2022.

BTC-e was founded in 2011 and was seized by US authorities in July 2017, when they arrested several exchange staff for allegedly helping Russian criminals execute ransomware attacks, identity theft schemes, and narcotics trafficking.

Vinnik, meanwhile, maintains his innocence, claiming that during his time at BTC-e he had no say in matters related to helping foreign hackers.

South Korean Officials Must Declare Cryptocurrency Possession

South Korea moves towards transparency in cryptocurrency use by public officials, passing Kim Nam-guk Prevention Law.

The South Korean National Assembly has taken a significant step towards transparency in the use of cryptocurrencies by public officials. This week, the South Korean parliament unanimously passed a law requiring officials to declare their cryptocurrency holdings. This move, known as the “Kim Nam-guk Prevention Law,” is a direct response to a recent scandal involving various lawmakers and their activities with digital currencies.

The scandal that led to the creation of this law involves Kim Nam-guk, a former lawmaker accused of moving large sums of money through cryptocurrencies. The ongoing investigation seeks to determine whether Kim received cryptocurrency for free or at a discount and whether he used his position to obtain these assets. Now, with the passage of the law, all officials are required to declare any cryptocurrency holdings.

South Korean Officials and Cryptocurrency: A New Standard of Accountability

The new law sets an important precedent for accountability and transparency in the South Korean cryptocurrency market. Officials, from members of the National Assembly to high public officials, must adhere to this law.

With the unanimous approval of the amendments to the National Assembly Act and the Public Service Ethics Act, civil servants are required to declare their cryptocurrency holdings.

The measure seeks to include cryptocurrencies within the declarations that public officials must make with assets such as cash, shares, and real estate, only if they exceed KWR $10 million (approximately USD $7,500).

Benefits of the Cryptocurrency Declaration Law

This law has several advantages. First, it helps prevent corruption by preventing officials from hiding funds in digital assets. Furthermore, it ensures that officials do not use their positions to manipulate the cryptocurrency market.

Lastly, it recognizes the growing importance of cryptocurrencies in the global economy. As cryptocurrencies become more common, regulations like this become more and more necessary.

The Context behind the Law

Former National Assembly member Kim Nam-guk was at the center of a scandal when he was found to have $4.5 million worth of cryptocurrency in an account on the Wemix exchange.

The case is even more serious, as Nam-guk participated in debates and resolutions that postponed the entry into force of certain cryptocurrency-related laws. Such was the case of the proposal to establish a 20% tax on earnings with digital currencies, which was delayed until 2025 after a vote by the members of the Assembly.

Despite all this, Nam-guk claimed that his cryptocurrency investments and actions towards certain laws related to such assets did not constitute conflicts of interest:

“I did not borrow or receive money from anyone (for cryptocurrency trading). I sold some of my assets to use for the initial crypto investment. I have also transacted only through real name accounts and can transparently share all transaction records.”

However, personalities from the local political scene strongly rejected Nam-guk’s position and argued that this situation reveals important ethical and moral conflicts for the position he assumed since the delay of certain laws has greatly benefited him on a personal level.

Regarding this bill, now that it has been approved by the local Assembly, all that remains is to wait for the president to sign it for it to enter into force. If this happens, South Korea would lead nations like the US and the UK in requiring their public officials to declare their cryptocurrency holdings.

These developments mark an exciting phase for Uwerx and its community, who are eagerly anticipating the debut of the platform and the transformative opportunities it will bring to the freelance industry.

Ether and the Absence of Crypto Regulation in the US

The absence of a clear regulation to cover the US crypto market creates ambiguity towards some digital assets such as Ether.

The absence of regulation affects almost all crypto market projects, be it tokens like Ether or exchanges like Coinbase. Two regulatory agencies claim the right to rule over this type of digital asset, which increases uncertainty.

The Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) are the two self-proclaimed governing bodies. The former is in an aggressive crusade against companies of all kinds. Although the SEC has claimed sovereignty over the crypto sector since 2018, it was only recently that they sharpened their campaign.

How Does the Absence of Regulation Affect Tokens Like Ether?

The absence of clear regulation leads to tokens like Ether getting caught in the crossfire of traditional regulatory agencies. Consequently, if there is a definitive regulation, crypto projects would know what to expect and what steps they should take to avoid non-compliance.

Meanwhile, crypto market projects such as token issuers must act as if they were commodities and securities at the same time. This is a difficult balance since considering one way and the other at the same time would considerably limit the existence of these projects and their interaction with the public.

Be that as it may, tokens like Ether can be interpreted under the laws of each agency, and that reality will continue, as long as the regulatory absence is maintained. Technically, some experts say, the native token of the Ethereum Blockchain can be considered a commodity or a security.

ETH is a Commodity and a Security at the Same Time

The expression “neither hay nor grass” does not apply to the Ether token when it is considered by the aforementioned regulatory agencies. In the same way that the SEC could penalize the creators of Ethereum, so can the CFTC.

In a recent appearance on the Unchained podcast, former CFTC Commissioner and former SEC General Counsel Dan Berkovitz was emphatic when stating that the native Ethereum token can easily pass as a security and as a commodity. In other words, ETH can be legally subject to the laws of the two agencies simultaneously.

Regulatory confusion over the status of this token leads crypto experts to clamor for clear laws. During the last few months, the CFTC has been classifying ETH and other currencies as commodities. In parallel, Gary Gensler, the head of the SEC stated in April that all tokens, except Bitcoin, can be considered as securities.

According to the former official of these regulatory agencies, the laws leave no room for further interpretation. That means that the token can be perfectly regulated by either of the two agencies that take the first step. “The law is clear. Actually, something can be both a commodity and a security,” he said during the podcast.

This implies that the absence of specific regulation is not a problem for Ether. Consequently, under either scenario, crypto users could face a stiff penalty for breaching established laws.

Ethereum Traders Fighting for Exits After Price Crash

Ethereum prices crashed unexpectedly on May 24.

The surprise collapse in Ethereum prices sent the coin below last week’s lows, toward the psychological level of $1,800. Following this dump, Coinalyze on-chain data reveals that there has been a sharp drop in open interest, suggesting that some traders were caught off guard and had to exit their positions.

Ethereum Open Interest Drop

On May 24, ETH’s open interest stood at $5.2 billion across all major cryptocurrency exchanges such as Binance and OKX. Of this, $4.7 billion was from perpetual futures, while less than $450 million was from futures.

In cryptocurrency derivatives trading, open interest is the total number of open positions. These positions can be long or short and drawn from perpetual futures and futures from leading platforms.

Being derivatives, open interest positions are often leveraged, meaning the trader borrows funds from the exchange to trade a larger lot size. In this way, merchants have to assign collateral, which is margins, to finance the operation. Depending on the lot size of the trade and the leverage used, there may be “margin calls”. In such a scenario, when the price of the underlying asset moves against the expected direction, the exchange may sell the collateral to protect itself if the trader does not increase his margin.

On May 24, ETH prices, in line with the general trend in crypto markets, fell by approximately 5%, from a high of $1,875 to a low of $1,775. This reversed the gains of the past two weeks, forcing the coin lower in sync with the losses of late April and early May 2023.

As a result of this correction, data from Coinalyze shows that open interest in Ethereum positions plunged 7.3%. There are now $5.2 billion in ETH derivatives positions, most of which are on Binance, the world’s largest cryptocurrency exchange.

Binance has $2.1 billion in ETH positions as of May 24, while OKX and Bybit each have $1.1 billion and $1 billion, respectively.

There is approximately $189 million in open ETH positions on dYdX, a decentralized exchange (DEX). According to available data, traders still prefer custodial cryptocurrency exchanges when trading ETH derivatives. There are non-custodial options, such as dYdX, that are gaining momentum.

Millions of ETH Longs Settled

Data from Coinalyze also shows that only $18.7 million of ETH “long” positions have been liquidated by exchanges in the last 24 hours. In total, there were $22.4 million in liquidations, indicating that most traders were bullish and expected prices to rise in the coming days.

Ethereum prices are bearish, contracting the day before and extending losses from late April when the coin soared to $2,100 despite positive on-chain data flow. As of May 25, the total amount of ETH staked, securing the proof-of-stake network, stands at record levels of over $41 billion.

According to CryptoPredictions, the ETH Price is forecasted for today (25.05.2023) to be in the $1,515.978 – $2,229.379 price range. Ethereum is predicted to end today at $1,783.503. Ethereum started in May 2023 at $1,885.392 and is predicted to finish the month at $1,488.748. During May, the maximum forecasted ETH price is $2,115.261 and the minimum price is $1,438.377.

Before making any financial decisions, though, it is always best to do your own research.

XPeng Shares Slide 5% After Weak Q1 2023 Exit and Q2 Deliveries Forecast

Shares of China’s XPeng were trading lower in the US ahead of trading after the electric vehicle company forecasted significantly lower vehicle deliveries for the second quarter.

Shares of Chinese electric vehicle (EV) giant XPeng Motors (NYSE: XPEV) fell 5%, after losing first-quarter earnings and a grim delivery forecast. XPeng shares plunged in US premarket trading after the company reported a 50% year-over-year (YoY) decline in first-quarter revenue.

The company posted revenue of 4.03 billion Chinese yuan ($571.6 million), compared with the 5.19 billion yuan analysts had expected. For the first quarter of 2023, Tesla’s Chinese rival also suffered a net loss of 2.34 billion yuan, versus the 1.9 billion expected.

XPeng’s latest quarterly deficit surpassed the 1.7 billion yuan loss suffered in the same quarter last year. XPeng Chairman and CEO, He Xiaopeng, weighed in on the company’s quarterly performance, saying the following:

“During the first quarter of 2023, I made changes to our strategy, organizational structure, and senior management team decisively. I am fully confident in taking our company into a virtuous cycle, driving product sales growth, team morale, customer satisfaction, and brand reputation over the next few quarters.”

XPeng Forecasts Lower Second Quarter Vehicle Deliveries and Rising Revenues Amid Stock Slide

With the shares currently trading at $9.11, XPeng forecasts at most 22,000 vehicle deliveries in the second quarter. The company’s latest restricted delivery guidance of between 21,000 and 22,000 EVs represents a year-over-year decrease of 36.1% to 39.0%.

In addition, XPeng’s forecasted second-quarter revenue of 4.5 billion yuan to 4.7 billion yuan represents a year-on-year decline of 36.8% to 39.5%. However, he remained optimistic about the company’s prospects, especially regarding its soon-to-be-launched G6 SUV.

The EV rolls off the assembly line next month, and the XPeng CEO believes it will become a popular and best-selling model in China. Meanwhile, XPeng Honorary Vice President and Co-Chairman Hongdi Brian Gu stressed the company’s commitment to achieving sustained profitability in a saturated market. Gu commented on the issue as follows:

“[As we advance], our top priority remains to accelerate growth in sales and market share. As the upcoming G6 launch and other new product launches fuel rapid sales growth, we expect our cash flow from operations to improve significantly.”

XPeng’s recent underperformance is due to weakening macroeconomic parameters in China. This includes mixed consumer spending in an uneven economy still reeling from strict Covid protocols.

In addition, the Guangdong-based EV maker has also ceded some of its market shares to increasing competition from other EV companies.

Although Tesla recently increased the prices of some of its EV models, the company’s previous price cuts hurt XPeng’s competitiveness.

Europe Push

In early February, XPeng, amid increasingly intense competition at home and abroad, launched its flagship electric vehicle models in Europe. The push abroad serves to increase the visibility of the Chinese company’s brand, thereby gaining potentially lucrative overseas market share.

On February 3, XPeng launched its P7 sedan and G9 SUV in Denmark, the Netherlands, Norway, and Sweden. At the time of the European launch, the Chinese EV maker priced its P7 sedan below Tesla’s EVs.
