SEC vs. Binance: Regulator Is Caught Between Lying or Misleading the Public

Binance emphasizes the need for clear and truthful communication, as this case could set a precedent for regulatory actions in the marketplace.

Regarding the case SEC vs. Binance, in an unprecedented turn of events, allegations of dishonesty and misleading the public have surfaced against the United States Securities and Exchange Commission (SEC). Binance and its partner companies took the drastic step of seeking court intervention on June 21.

The industry giant aims to hamper the SEC’s propensity to make controversial statements that it alleges are seriously misleading and potentially damaging.

Binance Calls for SEC to Comply with Rules of Conduct

The recent motion stems from the agreement between the SEC and Binance on a consent order outlining how Binance.US could use its funds. In what Binance saw as a flagrant violation of this agreement, the SEC issued a press release that sparked widespread concern on the cryptocurrency exchange.

In the press release, the SEC claimed to have obtained “emergency relief” to protect the assets of Binance.US clients. It depicted an image of Binance and its CEO, Changpeng Zhao, in control of client assets, thus suggesting that they could misuse these assets.

“Since Changpeng Zhao and Binance are in control of client assets on the platforms and have been able to combine client assets or divert client assets at will, as we have alleged, these bans are essential to protect the investors’ assets,” said Gurbir S. Grewal, Director of the SEC’s Division of Enforcement.

Binance refuted the claims as they were contradicted by the SEC’s statements in court that it had no evidence. The company claimed that the SEC’s portrayal of the situation is not only disappointing but disturbingly misleading.

“At the very least, the SEC’s statement contravenes the principle that the SEC so often cites: it omits material facts necessary to ensure that the statements being made are not false or misleading,” the filing read.

In the courtroom, SEC representation had a hard time corroborating his statements. When asked about the possible diversion of assets from BAM Trading Services and BAM Management US Holdings, the SEC was forced to admit that no such violations had occurred.

Furthermore, Binance claims that the SEC’s claims to have “obtained emergency relief” are misleading. The company claims that weeks of negotiation produced this remedy, and the defendants acquiesced in it. There is, they emphasize, no evidence to suggest that the assets of BAM’s clients are in jeopardy.

The issue lies in the alleged misinformation propagated by the SEC press release. The BAM companies argue that these statements may have a material impact on the case. Therefore, it requests that the court enter an order compelling the SEC to adhere to the established rules of conduct.

SEC vs. Binance: The Beginning of a Long Journey

The case of SEC vs. Binance underscores the volatility and dynamism inherent in the cryptocurrency industry. With one of the largest platforms under scrutiny, the outcome of the case could set a precedent for future interactions between regulators and crypto companies.

As such, all parties involved should not underestimate the need for truthful, clear, and transparent communication.

Facing serious allegations of misconduct and dishonesty, the SEC now finds itself in the spotlight. It is not clear whether or not the responsibility for his statements will fall on the SEC. Still, the integrity of regulatory bodies is as critical as the institutions they oversee.

As the saga between Binance and the SEC continues, the broader implications for the crypto market will undoubtedly go deeper.

Uniswap Founder Slams SEC Regulatory Approach to Crypto

The US regulatory approach towards the crypto market is “unfortunate”, says the founder of Uniswap, Hayden Adams.

The approach to compliance with regulatory laws towards the cryptocurrency market in the United States is known for its extremism. In particular, the Securities and Exchange Commission (SEC) does not play a fair game when it comes to applying regulations against companies in the sector.

Such a situation is counterproductive for innovation, claims the founder of Uniswap, Hayden Adams.

During an interview with Laura Shin on the Unchained podcast, the crypto businessman criticized the regulatory authorities of the North American country regarding the treatment of the crypto sector. In his opinion, they have not been “very considerate or very good” with that industry. Adams further states that this approach is a barrier that hinders the development of the crypto industry in the US.

Earlier this month, the SEC slammed hard against the major digital currency trading exchanges, Coinbase and Binance. The agency accuses the platforms of allowing securities to be traded illegally. These companies reject that the tokens they trade belong to the category of assets over which the SEC has authority.

SEC is an Obstacle to Development, Says Uniswap Founder

Following the directives of most exchanges and other crypto firms, the SEC acts intransigently. Therefore, instead of looking for solutions in a sector that is taking its first steps, it is in charge of crushing it with the application of laws that are probably not compatible with the crypto area.

For the founder of Uniswap, the SEC is treating cryptocurrencies as if they were securities, which means that they are applying the same rules that work for traditional financial assets.

Adams further stated that this becomes extremely problematic, considering that cryptocurrencies are a new and evolving technology. In this sense, they cannot be adjusted to the laws established on securities. This forced framing of some assets towards laws that are not compatible with them, he points out, generates fear in the industry and inhibits ventures based on technological development.

At this point, the founder of Uniswap believes that the North American country should work on a new regulation for cryptocurrencies. This advance would allow the regulatory clarity that businessmen require. This vision is now the main battle flag of the companies in the sector in that nation.

The US Is Falling Behind in Crypto Development

The SEC’s “unfortunate and sad” approach to the treatment of crypto companies is hurting innovation in the US, says the founder of the Uniswap protocol. Competition with other markets appears to hurt the United States as a result of the agency’s conservative approach.

With clearer regulations, other countries will be able to boost innovation, while the United States lags behind. The worst of this could be that the projects in the North American country, harassed by the SEC, end up leaving for more “livable” places.

If the SEC considers a new category to include cryptocurrencies, the regulation would be considerably easier, according to Adams, who is definitely a strong critic of the SEC’s regulatory approach. In his opinion, the conservative approach must change, since it is detrimental to development and innovation in the US.

Colombian Authorities Express Disagreement with the Use of Cryptocurrencies

0

The Colombian Minister of Finance assures that digital assets are a reality, and there is enormous interest in regulating them. The Financial Superintendent thinks otherwise and ensures that cryptocurrencies are a very dark market that lends itself to speculation. According to the Directorate of National Taxes and Customs (DIAN), in Colombia, there are more than 680 businesses that accept cryptocurrencies as means of payment.

The Minister of Finance and the Financial Superintendent of Colombia showed their contradictory positions regarding the role of cryptocurrencies in the country.

During the 57th edition of the Banking Convention organized by Asobancaria de Colombia, the Minister of Finance Ricardo Bonilla shared his perception of cryptocurrencies in the country.

For the Minister, these digital assets are a reality, and there is enormous interest on the part of the government to regulate their use in the national territory.

The Use of Cryptocurrencies and the Importance of a Regulation in the Country

Bonilla assured that the use of cryptocurrencies should be seen as financial operations, so they should be reviewed and regulated with the same rigor.

During the Banking Convention, Bonilla also indicated that the current government is interested in regulating crypto assets. Therefore, the Sixth Commission of the Colombian Senate recently approved the third debate of four for a bill that seeks to regulate exchanges:

The Colombian Minister of Finance also stressed that it is paramount to properly handle the issue of crypto assets. This is due to the increase in their use within the country.

“The Bank is interested in advancing on the issue. Crypto assets are a reality, but we cannot allow them to be introduced in any way,” says Bonilla.

The Opposite Position of the Superfinanciera of Colombia

Despite the fact that they are part of government entities, the representative of the Financial Superintendence expressed a contradictory opinion in this regard. According to Valora Analitik, César Ferrari believes that cryptocurrencies should not be seen as financial operations in the country.

For Ferrari, cryptocurrencies are a dark market, since “it is known who demands them but not where they originate.” He further added the following:

“I, personally, tell you that this market for crypto assets, which are not assets, which is not a financial market, does not have to be in the care of the Superfinanciera (…) It is a very dark market that lends itself to speculation.”

Cryptocurrencies in Colombia: Usage Figures

In Colombia, the use of cryptocurrencies has been increasing in recent years. To get an idea, Mastercard’s New Payments Index report revealed that, during 2022, 15% of Colombians made transactions in digital currencies with values ranging from $100 to $2,000.

In December 2022, a study by the firm Finder ensures that Colombia is one of the countries with the largest number of cryptocurrency owners in the region. A total of 5.6 million Colombians own these digital assets.

Furthermore, as if this were not enough, its adoption is also evidenced by the sites that already accept payments with these assets in the country. The DIAN (Directorate of National Taxes and Customs) assured that this year there are more than 680 businesses that accept cryptocurrencies in Colombia.

Blackrock’s Spot Bitcoin ETF Renews Optimism and Prompts a Burst of New Filings with the U.S. SEC

At least two investment firms have filed new applications for spot bitcoin exchange-traded funds (ETFs), after investment colossus BlackRock filed a related application for its own spot bitcoin ETF on June 15th.

New York-based asset management fund WisdomTree is the latest investment firm to file a new application for a spot bitcoin ETF. According to a June 21st filing with the U.S. Securities and Exchange Commission (SEC), WisdomTree asked SEC to allow it to list its “WisdomTree Bitcoin Belief” on the Cboe BZX exchange under the ticker “BTCW.”

WisdomTree has applied for a spot in Bitcoin ETF on two previous occasions. Its first application was rejected by the SEC in December 2021. Its second application was rejected again in October 2022, with the financial regulator citing similar fraud and market manipulation concerns. At the time of this publication, WisdomTree oversees approximately $83 billion in assets.

One of the key differences in BlackRock’s recent SEC filing is that it intends to enter into a “shared oversight agreement” with the Chicago Mercantile Exchange (CME) futures markets.

BlackRock’s proposal cites the SEC’s approval of a bitcoin futures fund of investment advisory firm Teucrium. That ruling noted that CME “comprehensively monitors futures market conditions and price movements on a genuine time and continuous basis in order to detect and prevent price distortions, including price distortions caused by manipulative efforts.”

This has also been echoed in WisdomTree’s filing, which states that it is willing to enter into such a surveillance agreement with “an operator of a US-based bitcoin spot buying and selling platform.”

Less than four hours after WisdomTree filed its application, global investment manager Invesco “reactivated” its application for a comparable product. And now Invesco has reactivated its 19b-4 for its spot ETF.

According to the 19b-4 filing – which informs the SEC of a proposed rule change – Invesco asked the financial regulator to allow its “Invesco Galaxy Bitcoin ETF” product to be listed on the Cboe BZX exchange.

The filing indicates that a spot bitcoin ETF that uses “professional custodians and other service providers” eliminates the need for investors to rely on “under-regulated offshore vehicles” in turn, allowing investors to more easily “protect their core bitcoin investments.”

While the SEC has yet to approve a single spot bitcoin ETF product, Bloomberg senior ETF analyst Eric Balchunas said that “BlackRock breathed new life into the race” in response to his own tweet regarding WisdomTree’s filing.

In addition, Balchunas said crypto investors might have good reason to be optimistic about BlackRock’s move, sharing that the investment firm has a “575-1” record in getting ETFs approved by the regulator.

In addition to recent activity from WisdomTree and Invesco, rumors have begun to swirl that multibillion-dollar fund manager Fidelity Investments may also be looking to capitalize on the new bitcoin spot ETF frenzy.

In line with a June 19th tweet from Arch Community co-founder AP_Abacus, Fidelity Investments, which manages some $4.9 trillion in assets, may apply for its own spot bitcoin ETF. Alternatively, Abacus notes that the investment firm could bid on Grasyscale’s GBTC ETF product.

Deutsche Bank Seeks License for Custody of Digital Assets

0

German financial giant Deutsche Bank recently applied for a license for digital asset custody service.

Deutsche Bank, one of the largest financial institutions in Germany, wants to advance its custody services for digital assets. To do this, the lender requested a custody license from the Federal Financial Supervisory Authority (BAFIN).

This request is carried out in response to the growing demand for custody services by the entity’s clients. Other financial institutions in the country would be on the same footsteps, forcing Deutsche Bank to act to prevent clients from contemplating leaving.

“We have just submitted an application to BAFIN for the license,” said David Lynne, director of the institution’s commercial banking unit. This new advance is part of a broader strategy by the bank to increase fee income, the executive explained, quoted by Bloomberg.

Deutsche Bank Wants to Expand its Services Through Custody of Digital Assets

If licensed, the German lender will be able to offer digital asset custody services to its clients. With this, the rumors of the enthusiasm of the directive in this sector that grows in popularity are confirmed. Thus, important institutions are flirting with the crypto market.

In simple words, the bank’s clients will have the opportunity to store various types of assets from the virtual area. These include cryptocurrencies and other types of tokens, which could be in registered, secure and regulated accounts.

Said license request is made under the BAFIN regulatory framework. It is the agency in charge of supervising the financial market of the European country, responsible for ensuring that all financial institutions comply with the established rules and regulations.

According to Bloomberg, the German bank has been working on its own digital asset custody platform since 2020. However, this initiative was not accompanied by a tentative date to launch any product, until now, with the license application.

With this step, the world of digital currencies seems to be moving towards a more secure and regulated environment. So far, one of the main fears among investors is that putting capital into assets like cryptocurrencies is fraught with great risks.

Ensuring the Safety of Client Funds

With the possibility of providing custody of digital assets, the German bank takes a step in the fight against fraud. In that sense, client funds would not end up in the hands of platforms that could be fraudulent, as in the case of FTX. Likewise, the institution ensures that deposits do not leave their accounts.

The growing popularity of cryptocurrencies causes many people to withdraw their savings from banks and place them in exchanges. In simple words, traditional banking faces an existential dilemma in which they must adapt to the new needs of customers. Thus, Deutsche becomes one of the pioneering institutions in offering these services that include crypto market assets.

It is to be hoped that this is the first of successive requests by other lenders. The trend towards the use of cryptographic assets and tokens seems to be very close despite the immaturity of that market. By turning to this new form of finance, big banks are helping regulatory efforts to prevent crimes like money laundering.

The coverage of services such as the custody of digital assets can have both positive and negative sides.

Three Reasons Why BTC Soared to $29K – Can It Continue Higher?

It looks like the market has finally caught up with the news and reacted the way most expected.

The Bitcoin price rose more than 7% in the last 24 hours, a move that resulted in a wave of selloffs, most of which were unsurprisingly short.

Interestingly, this comes at a time of considerable uncertainty in the United States in terms of regulatory clarity. The SEC recently filed two lawsuits against the world’s leading cryptocurrency exchanges: Binance and Coinbase, alleging that both violated securities laws.

So why is the price of Bitcoin rising? Well below are three possible reasons.

BlackRock Applied for a Bitcoin ETF

BlackRock is the world’s largest asset manager and has taken a big step towards legitimizing Bitcoin as an asset class worth investing in. The company filed for a spot Bitcoin Exchange Traded Fund (ETF) with the United States Securities and Exchange Commission.

While this may sound like an old story, there is one worthwhile difference between BlackRock and every other company that has applied for a spot Bitcoin ETF thus far. The former has an ETF success rate with the SEC of 575 to 1.

That’s how it is. BlackRock has filed 576 applications and only one of them was denied. And it was almost a decade ago.

Needless to say, an approved Bitcoin spot ETF is expected to have considerable industry-wide implications, as it would legitimize the asset and allow institutional investors to get involved without the underlying concerns they currently face.

More Bitcoin ETF Applications

This has given wings to other large companies to renew their efforts or start from scratch. WisdomTree, a global financial firm, is trying once again to start a spot Bitcoin ETF in the US. The filing came yesterday.

Invesco, another investment management firm with around $1.4 trillion in assets under management, has also reapplied for a spot BTC ETF. The company first filed with the SEC in 2021 along with Galaxy Digital.

It seems that BlackRock’s application has given a lot of hope for approval, thanks to the reputation, stature, and size of the company.

Wall Street-Backed Crypto Exchange EDX Goes Live

A cryptocurrency exchange called EDX, backed by Charles Schwab, Citadel Securities, and Fidelity Digital Assets, officially launched and began trading yesterday, according to recent CNBC coverage.

The exchange allows trading of select cryptocurrencies such as BTC, ETH, LTC, and BCH; none of these were called “crypto asset securities” in the recent lawsuit the US Securities and Exchange Commission filed against Coinbase and Binance.

Can the BTC Price Go Higher?

In their latest Bitfinex Alpha report, analysts at the popular exchange noted the resilience of the crypto market amid ongoing regulatory turmoil in the US. However, they also argued that despite the significant move higher, the price failed to generate a short contraction.

Bitcoin’s rapid rally last week from the all-important $25,000 barrier did not lead to a short squeeze, indicating that the price appreciation was not the result of short liquidations, but perhaps the result of sizable long futures positions that held the price up.

Bitfinex argues that if the bulls manage to continue driving the price higher, it could eventually trigger a short sell-off cascade, catapulting the price higher.
